Scott G. Stewart will fight to keep a Mississippi legislation that prohibits abortions after 15 weeks on the books. Furthermore, the law was deemed unconstitutional by lower courts.

Thousands of people and organizations have written to the Supreme Court in the weeks leading up to Wednesday’s important abortion case, pushing the court to save or overturn two landmark abortion judgments.

They’ll hear from only three lawyers on Wednesday: one representing the state of Mississippi, another representing Mississippi’s only abortion clinic, and the third representing the Biden administration. Nevertheless, it’s an opportunity for each of them to be a part of what will almost certainly be a landmark case.

Scott G. Stewart will defend a Mississippi law that would ban abortions after 15 weeks. Lower courts declared the law unconstitutional.

Solicitor: Who Is Scott Stewart Mississippi?

Scott G. Stewart will fight to keep a Mississippi legislation that prohibits abortions after 15 weeks on the books.

Even though this is Stewart’s first Supreme Court visit, some of the justices will recognize him. Stewart was also a law clerk to Justice Clarence Thomas in 2016, when the court ruled in favor of abortion opponents, overturning Texas’s widely replicated rules requiring doctors who perform abortion-related procedures to have admitting privileges at nearby hospitals and forcing clinics to meet hospital-like outpatient surgery standards.

That judgment drew Thomas’s dissent, and Stewart’s argument that the justices should overturn Roe and Casey is one that Thomas has taken.

Stewart served for the Trump administration’s Department of Justice before becoming Mississippi’s solicitor general. In that capacity, he defended measures like detaining asylum-seekers in Mexico while immigration court hearings and prohibiting a pregnant adolescent detained by the government from having an abortion while in federal custody.
